The Court’s Ruling

In a Memorandum Decision issued today, the West Virginia Intermediate Court of Appeals (No. 25-ICA-215) affirmed the Circuit Court of Jefferson County’s grant of summary judgment in favor of Maple Hill Homes, LLC. The Court’s decision centered on several key legal principles:

  • Lawful Conveyance: The Court confirmed that a tax-delinquent property owner retains the legal right to convey their property until a tax deed is officially executed.
  • Timely Redemption: Evidence showed the redemption payment was received by the State Auditor on April 29, 2024, meeting the specified deadline.
  • Ownership Rights: Because the redemption occurred before any tax deed was issued or requested, the petitioners’ right to the deed never accrued, leaving Maple Hill Homes, LLC as the rightful owner.
