Campbell Casto Clark, P.C. Secures $16.3 Million Judgment in Fairfax County Jury Trial; Court Confirms Treble Damages Are Mandatory Under Virginia Law

Leesburg, VA – February 25, 2026 –Campbell Casto Clark, P.C. is pleased to announce a major victory in the Circuit Court of Fairfax County on behalf of its client, Bala Jain, LLC.

Following an eight-day jury trial in September 2025, the jury returned a multi-count verdict in favor of Bala Jain arising from a complex fraudulent real estate investment scheme involving 25 loan transactions. The jury awarded $5,429,608.77 on the claim for Statutory Business Conspiracy, along with additional awards on fraud, civil conspiracy, breach of fiduciary duty, unjust enrichment, and other related claims. 

On February 20, 2026, the Circuit Court of Fairfax County issued a Letter Opinion holding that treble damages under Virginia Code § 18.2-500(A) are mandatory—not discretionary—upon a finding of liability for Statutory Business Conspiracy. 

As a result, the jury’s $5,429,608.77 Statutory Business Conspiracy verdict was trebled to $16,288,826.31. Because the jury’s awards on the various counts were duplicative of the same losses, Bala Jain’s total recovery is limited to the trebled amount of approximately $16.3 million. 

In its Letter Opinion, the Court squarely addressed a question that the Supreme Court of Virginia has previously acknowledged, but not decided—whether treble damages under Va. Code § 18.2-500 are mandatory. The Court concluded that the statutory language requires courts to award three-fold damages once compensatory damages are awarded for Statutory Business Conspiracy. 

The case arose from a scheme in which the defendants, Amit and Monika Jain, exploited religious and cultural ties to persuade Bala Jain’s sole member—an elderly investor—to fund nearly $6 million in real estate loans under false representations that the investments would be secured and protected by first-lien positions.

Campbell Casto Clark’s trial team, led by partners James P. Campbell and Matthew L. Clark, with support from Senior Paralegal Lis Longmire, successfully defeated a motion to strike, prevailed before the jury on multiple counts, and secured a post-trial ruling confirming mandatory treble damages under Virginia law.
